Why Is It Important to Protect?

Intellectual property is the result of intellectual work, the product of human creative activity, an intangible asset that may be granted legal protection measures. Intellectual property covers industrial property objects and copyright objects. Its creator (or organisation) is granted exclusive rights to use, commercialise, or license this asset.

To make full use of the potential of intellectual property – to gain academic recognition, obtain material returns, establish start-ups, or collaborate with business – it is essential to ensure its protection as early as possible. This is particularly important before giving public presentations, submitting publications, or starting negotiations with external partners.

An invention patent is one of the forms of intellectual property protection, granting the inventor exclusive rights to use their technical solution. This may be a new product, material, method, or device.

A patent is a form of territorial protection of your invention. In the Republic of Lithuania, a patent is granted by the State Patent Bureau. However, in order to protect an invention abroad, registration is required in other countries or through international systems.

Invention Patentability Criteria

  • Novelty: the invention must not have been disclosed before the application is filed (neither publicly announced nor used in Lithuania or elsewhere).
  • Inventive step: the solution must not be obvious to a specialist in the field – it cannot simply be a straightforward combination of existing solutions.
  • Industrial application: the invention must be applicable in manufacturing or usable in various fields – industry, agriculture, medicine, etc..

Patenting routes and processes  

Main patenting routes:

  • National patent – application submitted to a specific country, valid only in that territory.
  • European Patent (EP) – a single application to the European Patent Office, extended to the selected 39 countries. Since 1 June 2023, the Unitary European Patent may also be chosen, currently covering 18 EU member states.   • Eurasian Patent – valid in 9 countries (mainly in the CIS area).
  • International Application (PCT) – covers up to 158 countries. This is a preliminary procedure allowing the postponement of national or regional applications. Learn more →

Patenting process at LSMU

  1. Idea! The first step is completing an invention disclosure or trademark form in the INTTO module.
  2. The form is submitted to the LSMU Health Innovation Development Centre, which evaluates its patentability, commercialisation potential, and further steps.
  3. Consultations with patent attorneys – as needed, partners are selected for application preparation and evaluation.
  4. Application submission – registration at the State Patent Bureau or in chosen international systems.

Important: Before submitting publications or presentations, it is always recommended to consult the Innovation Centre regarding IP protection.
